The comparison might be carried pursued in throughout much further
but than to for the present purpose, this much will
at least be deemed sufficient.
Whatsoever an other ends are necessary to justice
either the Courts of natural procedure either possess them
already in virtue of the unfettered latitude of authority, incident attached
to that unsophisticated mode of procedure, or might which the
Jury-trial inedification of technical procedure either
does not possess them at all, or possesses them in
but in some inferior footing, or in some inferior degree; or else in at the worst
might be made to possess them on a footing and in a degree more
advantageous than any in which those same and they could be
by that modification of the procedure
of which Jury trial seems the principal and only honest truth is the characteristic feature.
