Though of the legal powers necessary to the carrying
on the business of government this community in the society on special
part was this wanting, yet there was for a time
at least during which it might well enough appear
probable, that the business might go on as effectually
as if there were no such deficiency of legal powers. The
use of the existence and indeed only use of the real existence of these powers
