1823. Sept. Constitutional Code. 71.
Positions hereto relating.
1. On the understanding
the torment can not,
in so short a time,
have influence.
2. On the will it has
been constantly effectual.
3. In every instance
in which the refansnancy
has had place,
a violation of the engagment
has had
place, and the engagement,
including an
oath, the violation
has been perjury.
72.
4. {Added.} Subornoers.
those by whom,
having it, the hower to
alsogatethe oath and
the falsely declared agreement, the obligation
of taking it has
been continued: they
and their supporters.
&cusable, 13. even justifiable
the fenced her
jurers: notso the voluntary.
73.
Too absurd the supposition
that in every
instance is the torture begins to befelt,
belief groros grew and
strengthened with it.
Conceivable this; not
credible. Frequently,
where torture is not
employed, declared
diversity of opinion
has place: Never where
it is.
74.
7. Useless the torture
where the agreement
would have place
without it:hence, it
should be voted against
by whoever votes for it.
75.
8. According to him, the
effect being a orecessarily
extensive opinion
that perjury is produced
by the torture, it is
therefore worse than
useless.
