commonSense & not of Law to say, if this was a
carrying away & not a taking, what a taking was; and
that such an one if asked in any of these bases,
Is the Man carryingDid the carry the goods away? would either
be apt to say, no; take them he did, but he was
seized before he could carry them away.

On the negative side I find neither

I have drawn the Line of Consummation
at this state of the guilty Process, because 'twas at this that I thought it would be most conspicuous and least liable to Controversy. If not, let there be
supposed some Period posterior to and distinct from the
"taking" and let it be called the "carrying away"#

Now carrying away must be from some place
to some other: but to settle the by explanatory Aphorisms
the Limits between these two Places in every base that
might occur would lead into endless Difficulties and Disenssions; and to leave it to the Jury in every
base without any such Direction would induce great
