1. For the sake of symmetry, what is desireable is,

to a species of offence is a species of action; wit-
ness, mutitation, homicide; but, in some in-
stances, in the language of law writers, in gen
eral, and in that of the author in particular, it
has been the name of the not of the ac
tion, but of the result of it: witness, simple corpo
ral injury or injuries.

2. In some instances, the name of the of-
fence, involves in it the idea of wrong, and
thence of its being an offence; and, in this
case, the prefixing to it, any such adjunct as
the word wrongful would present the idea, not
only of superfluity but absurdity: witness,
theft, robbery and the like. But in other in
stances, this is not the case: witness in an as-
semblage of offences, a reference to property; witness colla-
tion, ablation, while, in another offence, belonging to the same group, to wit-usurpation, the idea of wrong is involved.
