march 16. 1826 Penal code
1. For the sake of symmetry, what is desireable is,
that, for giving expression to all the several offences,
in so far as may be, one and the same species of
conjugate, in the logical sense of the word conju
gate be employed.
Form
§ nomenclature-
1
For symmetry's sake
all offences to be denominated
by one & the same species
of conjugate
In general, the appelative, single-worded or
many-worded, employed in giving expression
to a species of offence is a species of action; wit-
ness, mutitation, homicide; but, in some in-
stances, in the language of law writers, in gen
eral, and in that of the author in particular, it
has been the name of the not of the ac
tion, but of the result of it: witness, simple corpo
ral injury or injuries.
2
In some instances the
denomination given is
the name of the action
in some that of its
result
2. In some instances, the name of the of-
fence, involves in it the idea of wrong, and
thence of its being an offence; and, in this
case, the prefixing to it, any such adjunct as
the word wrongful would present the idea, not
only of superfluity but absurdity: witness,
theft, robbery and the like. But in other in
stances, this is not the case: witness in an as-
semblage of offences, a reference to property; witness colla-
tion, ablation, while, in another offence, belonging to the same group, to wit-usurpation, the idea of wrong is involved.
3
In some instances the
name itself involves
the idea of wrong, in
others it requires the
addition of the adjunct
wrongful.
