<p>It is a hard an not an uncommon case where in<lb/>
a married couple either party betakes himself or herself out of<lb/>
the reach or knowledge of the other. Such a breach of the marriage<lb/>
contract may be termed Matrimonial Dessertion.<lb/>

<p>This case is the more distressing in as much as the party<lb/>
deserted may remain deprived of the comforts of matrimony<lb/>
not only during the life of the deserter, but forever after. As<lb/>
the <sic>desserter</sic> lived concealed so also may he die.
</p>
<p>Among the lower classes of people this mischief happens<lb/>
more frequently than people of the higher classes are aware<lb/>
of.</p>
<p>In the case of matrimonial desertion at the end of a<lb/>
certain time after proper notice, the party deserted ought to be<lb/>
free to engage in a new marriage; the deserter remaining bound, <lb/>
unless the party deserted should have made another choice.<lb/></p>
<p>A provision ought also to be made with regard to the effects<lb/>
of the deserter if he or she have any separate. Such effects<lb/>
the party deserted ought to have the power of taking into his<lb/>
or her management during the continuance of the marriage.<lb/>
