In so far as the motive<lb/>
is ill will, the<lb/>
suffering produced<lb/>
to wrongee and his<lb/>
connections is the<lb/>
wronger's profit of<lb/>
the offence.</p>
<p>2.<lb/>
Note, that if the smallest<lb/>
atom of the profit<lb/>
of the offence be<lb/>
omitted in the estimate,<lb/>
the law applies<lb/>
ultimately not a penalty,<lb/>
but a bounty.</p>
<p>3.<lb/>
In estimating the<lb/>
pecuniary circumstances<lb/>
of wronger<lb/>
with a view to reduction<lb/>
of punishment,<lb/>
the Judge will first<lb/>
state the relative<lb/>
circumstances, as<lb/>
near as he can guess<lb/>
them.</p>

He will then offer<lb/>
to the wronger, with a<lb/>
view to further mitigation<lb/>
of punishment,<lb/>
to give a particular<lb/>
account of<lb/>
the state of his pecuniary<lb/>

§. Punishment

1.
In so far as the motive
is ill will, the
