Ch. XII. Remedies
§. Punishment

1.
In so far as the motive
is ill will, the
suffering produced
to wrongee and his
connections is the
wronger's profit of
the offence.

2.
Note, that if the smallest
atom of the profit
of the offence be
omitted in the estimate,
the law applies
ultimately not a penalty,
but a bounty.

3.
In estimating the
pecuniary circumstances
of wronger
with a view to reduction
of punishment,
the Judge will first
state the relative
circumstances, as
near as he can guess
them.

4.
He will then offer
to the wronger, with a
view to further mitigation
of punishment,
to give a particular
account of
the state of his pecuniary
circumstances.
