<p>two non-expirees. These four fugitives were discovered by smoking<lb/>
the ship, an operation, for which the consent of the mater (for<lb/>
so it is particularly stated) had been obtained. Of the non-expirees<lb/>
it is stated that they had not yet served the full period<lb/>
of their sentences. From this statement it seemed <add>but</add> reasonable to<lb/>
<sic>inferr</sic> that even these, had they returned to England, would not<lb/>
have been landed there till after the day at which they had<lb/>
a right to land on British ground. Be this as it may,<lb/>
thus much is our doubt, that by this order the assurance<lb/>
given in the preceding one of August 1792 was <sic>compleatly</sic><lb/>
violated: and that in respect of the faculty of leaving the<lb/>
Colony, the condition of those who had a right, and those<lb/>
who had not a right, was the same: the same under the<lb/>
eye, and by the act of that very Governor, by whom the existence<lb/>
of the right had not seven months before, been noticed<lb/>
and recognized so that, by his own shewing, he kept them<lb/>
there in defiance of the law.<lb/></p>
<p>N. 12 (p. 283) 24th April 1793. A second opportunity for manifesting<lb/>
the sincerity of the assurance, and the manifestation is<lb/>
of the same kind. "But few Convicts" (meaning Expirees, says<lb/>
Captain Collins) "were allowed to quit the Colony in these ships:<lb/>
by which it is evident that it was want of permission on the<lb/>
part of the governor, and not want of room or any other<lb/>
faculty that prevented the numbers from being greater. The<lb/>
ships were two. On another occasion in Nov. 1794 it appears<lb/>
that the nubmer of Convicts received on board two ships only<lb/>
(the Endeavour and the Fancy) had been near an hundred<add>+</add>:<lb/>
whereof fifty by permission, fifty more without it.<lb/>
