Of Theft
given by regulations concerning pick-locks and
other implements of the trade (if such it may be
called) of homebuilding. As it is, the posession of
any of those implements so far in the
way of evidence, as to subject the to a
suspicion of theft in general. This however is not
sufficient for conviction: as since of itself it indicates
nothing concerning or individual articles of property
or the form or place. If then any such replacements
as could be sufficiently distinguished from other all such as
may be destined for an honest man, the possession of
them might be erected into an individual and substantive offence.
On this occasion the infirmity of the artist might
come in and of the sagacity of the legislation: by
contriving much as without violence, it
may not be profitable to him as by the help
of such instruments as it should appear plainly
could have been made for no other purpose. An
exception must always be made in favour of
