given by regulations concerning pick-locks and
other implements of the trade (if such it may be
called) of housebreaking. As it is, the possession of
any of those implements operating so far in the
way of evidence, as to subject the possessor to a
suspicion of theft in general. This however is not
sufficient for conviction: as since of itself it indicates
nothing concerning the or individual article of property
or the time or place. If then any such implements
as could be sufficiently distinguished from other all such as
may be destined for an honest use, the possession of
them might be erected into an independent and substantive offence.
On this occasion the ingenuity of the artist might
come in and of the sagacity of the legislator: by
contriving such fastenings as without violence, it
may not be possible to open as unlike by the help
of such instruments as it should appear plainly
could have been made for no other purpose. An
exception must always be made in favour of smiths
for the sake of such persons as by accident may
come to lose their keys: but in such case the artists
so excepted should be precluded from lending their assistance
to any other persons than such as are in their
