Of Confinement

Recapitulation — grand distinction to be attended to. The judge therefore in estimating the mischief of
this offence and measuring out the quantion for it it's
proper share of punishment will have his eye to two
principal cases. The first is where it either
involves in it's progress or terminates
in a distinct offence having it's own proper
nature characterized by it's own proper denomination
name. Theother is where it neither does not involves
nor or terminates in any such offence. In the
first case he will punish it as well in it's own
footing as in the footing of such additional
offence: in the other case he will punish
it on it's own footing merely.
