The judicial function I give the National
Asembly, is as I have several times observed
not likely to be very burthensome to them, for there
is but one individual in the Kingdom, or at most
but one very thinly-peopled species of individuals
on whom I give them the right of exercising it,
and that in a highly improbable case.

The committee could not give to the National
Assembly the functions jurisdiction of their High-Court of
Justice: for they have made it a Court of all
work. It is to judge criminally in the first place the Representative
bodies, in the next place all Judges
in the third place all Ministers, and in the last
place every body: for if my idea of the crime
of Treason against the Nation [lese-nation] is
the same as theirs it is what any body may
committ, a Porter as well as a Prince, a Newshawker as well as a Member of Assembly and that
as many people and in that in as many places as there are Parishes at a time.
It is what every any body would might be adjudged to have
committed who should be found on the unfortunate
side, should aristocracy (which God forbid!) have
a party that could make head, and men should
be found seen abetting to abet such party by overt acts.
