§. Alibi Evidence procured, how
Enactive
Art. 4. If the alibi evidence of the first remove is
true, the individual by whom the his own presence is that of another
at the place in question at the time in question has been deposed to and asserted will probably have been
guilty of mendacious testimony of juridical mendacity.
For the proof of this offence the alibi in a criminative suit for this
same offence the alibi evidence in question will naturally
be needed and endeavoured to be obtained.
Art. 5. For the consideration of the Judge it will be
whether to conduct the examination on this occasion in the oral
or the epistolary mode: if in the oral, whether by a witness
calling or a witness prehension and mandate.
Art. 6. Exception excepted he will in his witness-calling
mandate in which information concerning the purpose
for which the testimony or other evidence is needed.
Art. 7. Exception is – if in the opinion apprehension of the Jury
deception on the part of the proposed witness is to be promote on the occasion in question
in a preponderant degree likely to be promoted or facilitated:
in which case sinister will be the information or
instruction thus conveyed.
