In this case, though the expression by which
it will be necessary to designate characterize distinguish the two modes the expression
which it will be necessary to employ in designating and
distinguishing the two modes, are such as present to individual

yet it is not upon the nature of the signs that the difference
in point of eligibility turns, here the circumstances upon
which the eligibility turns is – not the nature of the
signs but the difference between constant presence and
mutual distance. For where mutual presence has
place, the to signs the presence of the commonest sort
signs of the permanent sort may are in use to be made succeed, and
accordingly under this Code are constantly made to succeed
signs of the everlastingly desirable sort.

In the case of the oral mode therefore the advantages
produced by the mutual presence are not waived:
whereas by the supposition in the case of the epistolary mode they are and
supposed to be waived. True it is that in point of practicability
a letter may be written in the presence of the person to whom it
is addressed: nor, in this, where subsequent publicity is contemplated,
and the approbation on the part of the individual person
addressed approbation of the whole tenor of it desired, and
consented to, is this mode of delivery altogether unexemplified:
as yet so likewise where the person addressed is deaf,
employed: but, generally speaking, this is not the mode of presence
commonly employed: so manifest, in point of time
and trouble, is the disadvantage.
