Constitutional Code. 1. Enactive Part
☞ Extend the above to insincerity of Advocates.
Art. 4. Of his own instance the Judge may uttered
the declaration opinion expressed in any one of the above means.
Art. 5. When at the instance of any party or on the occasion of the an original examination
of his own motion the Judge has uttered the opinion expressed
in the answer by which mendacity of assertion
is imputed to the person in question he may subjoin to
it an imperative decree ordering him to be subjected to
the punishment as for Quasi perjury appointed for the
crime so denominated: unless power to the party so
provisionally condemned to adduce at the definitive or recapitulatory
examination.
Art. 6. In this punishment is comprized the
obligation of making pecuniary compensation for whatsoever
damage may have been sustained or be about to be sustained
by any party in consequence of any evidence bestowed
by upon such false assertion or a equal to the amount
if, for want of credence by reason of non credence no such damage has been sustained
a equal to such damage as in case of credence
would have been sustained by a party an individual purely
interested supposing the case to afford include an individual so
circumstanced.
