Means of proof – how obtained or obtainable
§. 2. Evidence – by whom and from whom needed – from whom obtainable receivable.
Art. 1. The One person to whom in every case
article of evidence requires to be made known signified is the Judge.
When made known to him it must be either by a party
to the suit, by one who is not a party to the suit, or by his own sources
and faculties.
Art. 2. From a person who on either side is a party to the suit
so much as in his eyes makes in favour of his demand
will naturally be delivered spontaneously and without
reluctance. So much as in his eyes makes no disfavour
of his demand, not without reluctance.
Art. 3. An individual whose desire it is to commence a
suit against another will naturally, in if he thinks he has right on his side be disposed to present
himself to the Judge: were it only for the purpose of delivering
in his hearing such evidence as in his view makes in favour is in his favour
to of his demand. On the other hand An individual at whose expence a the demand
is placed made and who by that means is placed
in the situation of defendant will, in most cases as naturally be disposed
to evade avoid presenting himself before the Judge: but and supposing
him in the presence of the Judge, he will as naturally
be undisposed averse to give the giving answers to any interrogatories the
pursuer may address to him: and at the same time in but in in like degree
a correspondent degree he will be disposed inclined to address interrogatories to it the
party on the other side, by whom his repose has been thus
disturbed.
