Constitution Code or Procedure
Art. 11. Neither by accusation, by conviction, nor by
punition on account of one part of a mans persons discourse
as above, is the rest of it rendered unfit to be taken
into account. This is the case manifestly as to whatsoever
makes against himself in disfavour of his own interest or his own wishes: and as
to what matter in favour of them it follows not that
because as to what one point or on one occasion or as
to one point what a man has said has ben false, so
will everything have been that he has ever said
on any other occasion or as to any other point. In
regard to each point in every section in regard to
each point the Judge and the Quasi-Jury will form give
their opinion on the general whole complexion of the individual
case.
Art. 12. In respect of any such falshood in the case
of a party to the suit delinquency or non-delinquency is
has place independently of the circumstance of being on the
right side or the wrong side in respect of the demand
made by the suit: how little soever he had and
of it a person not only he who is in the right wrong but he who
is in the right may have been guilty of falshood with
for the purposes or in the course of the suit: for this falshood
it may be proper that loss of the suit in whole or in
part may be a proper punishment: but it does not
enter into the composition of the punishment as a matter
of course.
