§. Quasi Juries Checks?
or Commentative.
Art. 5. For misconduct on the part
of a Judge, the Jury not opposed by a Jury at the time suffered by those to pass unopposed, the Jury who were
sitting with him at the time are jointly also responsible,
as for : in such sort that, in the event of anany
accusations preferred against him, they may be comprized.
Art. 6. So likewise the Pursuer General and the Defender
General or their respective Deputies which so ever
were officiating at the time.
§. Evidence how obtained from a party litigant
Art. When evidence is obtained, it is either simply received
or extracted: simply received in so far as it proceeds spontaneously
that is to say of his own motion from him by whom it is
furnished; extracted, in so far as obtained by questions
or any interrogatories addressed to the individual in question
by, by authority of, the Judge.
In so far as in his view of it it will operate in his
favour, of his wishes it will, naturally speaking, be spontaneously offered by
him, and thus simply received from him: in so far as in
his view of it is will operate in his disfavour of his wishes it will not
be spontaneously offered and thence will remain to be
extracted: extracted from him by a party on the other side
or the suit, or by the Judge.
