Evidence Rules

Mode in which in its
original sense it was
subservient to justice:
it applied a veto to an
exercise of religious tyranny.
By government authority,
assumed and acted
upon had been certain
facts in the existence of
which the people were
commanded to deliver their
belief with several penalties
on all declaring
disbelief or doubt.
As to these facts many
had come to entertain
disbelief, and to believe
that by declaring belief
they would subject themselves
to torment
infinite in intensity
and duration to be inflicted
by an all benevolent as
well as almighty being
Under the direction By authority of government certain assumed facts
had been assumed and to exist and held up to view — facts the in the existence of which
the people were comu commanded to declare their belief
with the severest penalties for punishment demanded provided for
all who with relation to these same facts should presume to declare a disbelief or even doubt. In relation to these same assumed facts In a large
number more or less considerable and gradually encreasing the
people had come to entertain in their own minds a disbelief.
At the same time, were it so to happen that in relation to any
one of those facts which in truth were an object of disbelief
to him he were to declare it to be an object of belief, a
notion persuasion prevented among the people in question that by such
falshood, he would at the hands of almighty and all-benevolent
being be subjected to a state of infinitely intense or intense and
lasting torture lasting torture.

Comes now the tyrant
with one of his questions.
Answered one way
or left unanswered it
subjects the victim to
present torment: answered
another way, to endless
present fear of infinitely
greater future torment:
such the deliverance from
the view of which he derives
his enjoyment
Here then comes another tyrant with his questions: and
by these questions in addition to the punishment proposed by him such was to for himself the
satisfaction of subjecting the de to victim to this dilemma.
Answering one way the victim subjected himself to death preceded
by actual or present though stablilized torment: answering the
other way he continued suffering all his life under the
fear of: future and never ending torment.

The species of case crime to be punishable. The individual

The crime in this case what was it? in what
did it consist? In the entertaining of the obnoxious pursuers
or in the declaration of it. If in nothing but the entertaining it, the
correspondent declaration of it, if exerted by the fear of everlasting torment
was might if considered regarded in a certain point of view be
regarded on the footing of an accusation — of an act of self
accusation: for the hiding of an accusation proferred by
another person is to subject the person himself — the defendant to the punishment
