1824. Jany. 31
Constitutional Procedure CodeCh. Evidence
§. Exclusions

With equally no less flagrant absurdity and inconsistency
the evidence of a party to the suit is sometimes
admitted sometimes not excluded, sometimes exacted
sometimes not suffered to be exacted: admitted, as above when
the temptation to falshood is at its maximum excluded,
when at its minimum: exacted, when the suffering hardship from
the exaction is a its maximum: not suffered to be exacted
when at its minimum.

In the domestic judicatory all the scarcely
does any evidence present itself that is not the evidence
either of a party to the suit of a or that of a an interested witness
where or of an interested witness, whose interest if any an interested
such
the exclusion system were admitted shouldan interested
render him his testimony equally inadmissible.

The would most experienced could not can never
have been so far beneath the level of the least experienced
of mankind as those rules in the of the
honesty, those rules would prove them to be. Corruption
presents the only probable not to say possible cause.

Compare together the two systems of judicature judicial procedure the
natural and the technical, the rules of justice and the rules of judicature the more close the comparison
the wider will be seen to be the distance between
them the more revolting manifest shocking the repugnance.
For this distance corruption will be seen to afford the
only tenable cause.

Folly is an improbity thus matchless coupled with
assumption of matchless superiority of wisdom and probity
with an effrontery alike matchless – what a spectacle!
Yet if such f improbity though exposed to detection by such an
admixture of folly, to this day, so successful has been the frontery,
remain does the great community
remain still the dupe.
