§. Deception – modes

Art. 9. Of producing or endeavouring to produce deception
the most ordinary modes are testimonial falshood
and exhibition of false or fallaciious real or written
evidence. But a mode has place which does not in strict common
propriety come under any one of those heads. This is
deceptious and fallacious deportment, in for in this way and by the means which without employing discourse
or putting giving any permanent deceptious appearance upon to any portion
of matter deception may under favorable circumstances be
as effectually produced as in any other of those methods.
