Procedure Code

Art. 1. For exclusion of needless delay, vexation
and expence, it will be the care of the Judge that
unless the needfulness of it has been pre-ascertained,
no article of evidence shall be exhibited.

Art. 2. In this view, when at the first conjunct
meeting, parties on both sides are present in the judicatory,
he will elicit from all what are the facts on which
they respectively ground their demands, and what the evidence
is which they look to for probation of those several
facts.

Art. 3. This done, he will on parties on each side for
the purpose of ascertaining what, if any, they admit of the
facts, probation of which, if not admitted, will require
to be made on the opposite side.

Art. 4. A fact will be regarded as admitted by a
party to whose prejudice it tends to operate, unless
he declares his that he disbelieves of it, or at the least is
not satisfied of the existence of it.

Art. 5. In any one of these three cases, for the
more sure exclusion of needless delay, vexation and
expense, the Judge will, if he sees occasion, examine
the non-admitting party touching the grounds and causes
of such his disbelief, non-belief, or dissatisfaction, as the
case may be.

Art. 6. In For case of insincerity, in the course of any such
examination, the examinee is as responsible, compensationally
and punitionally responsible, as in case of mendacity in any
other shape.

Art. 7. In particular, when any document is exhibited
as and for the discourse of a certain person, especially
if for the purpose of authentication it bare his
signature, he will not, without special cause for
suspicion, call for any such evidence in proof of the hand-writing,
as shall be productive of additional delay
of expense.
