5. The Pursuer, Applicant, with the Pursuer if a
different person will now, in support of his demand have the faculty of putting interrogatories
to the Defendant, as well as any extraneous
witnesses whom the Defendant may have adduced.

6. The Defendant, on his part will have the like
faculty in relation to the Applicant, the Pursuer if a
different person and their witnesses.

7. For On the applicant must On this occasion the obligation be imposed
the obligation of attendance th to the end that he may
stand responsible for the verity and sincerity of the
statements, on which his demand had grounded itself, and
on the ground of by which the obligation of attendance has had been imposed
on the Defendant.

8. The Pursuer if different from the Applicant, will also and a
sot of person not incapable of attendance as per Art. .....
have to attend, partly for his own sake, partly for the sake
of the Defendant.

9. For his own sake it may be requisite that he
should attend be present, partly that he may have the advantage
of counter-interrogating the Defendant and the Defendant's
witnesses, partly that he may deliver his own testimony
if in the nature of the the circumstances of the individual
case have brought the ma any of the relevant facts
to under his cognizance, partly that he may obtain a prospect
of the remainder of any of the suit, and observe what ulterior
operation it may be necessary he should perform in relation
to it.

10. For the sake of the Defendant it may be requisite he
present, to the end that he may be subjected to any such apt interrogatories
as the Defendant may wish to put to him, and by that means
find himself under the necessity of making admission of any facts unfavourable
to his own side of the suit, or favourable to the Defendants side, as
may happen to have come under his cognizance.
