Procedure Code.
Art. 7. In this case Under really existing law the sole subject
matter of disagreement will in this case be the import
to be assigned to a certain assignable portion of the aggregate mass
of the whole body of existing law: commonly the import
to be assigned to some one phrase or even word in
some one Article.
Art. 8. In so far as such real law is wanting
recourse must of necessity be had, to some imagined
article of imaginary law – called in this case
sometimes Common Law sometimes Unwritten Law:
though in this case th in the standard of reference there
is commonly some hundred times as much of
or supposed matter on writing-press
than what is or would be contained in a compleat an all comprehensive body of
really existing law.
Art. 9. In this case each party adduces a pretended
portion of law made by his professional assistants for his
own purpose and says Thus saith the Common Law.
Its title to be acted upon as it would be right it should be
acted upon were it a portion of the mass of real law
remains in that case to be settled by upon and after representation.
