Constitutional Procedure Code.Ch. Costs
Add? Judge not paid by time.
The time for having argumentation arrived, not infrequently does it happen
by some this or that obstacle, real or imaginary – if real
natural or factitious is incapacitated from attendance:
the business is thereupon of necessity either put off to another
day with costs encrease of costs, or let drop into inferior
and imperfectly prepared because unexpecting hands.
The service for which the fee was given remains thus unperformed
the part taken by the receiver of the fee worse than useless to the giver: of the
return of it examples it is believed are not easy would not be easy to be found.
In this multiplication of hands some might see
or pretend to see that operation from which in manufacturing
in the conversion of raw materials into serviceable commodities
under the name of the division of labor such indirectly
so mighty an amount has been gained not division
but multiplication of labors are the operation and the
result here: multiplication of labour with more than deterioration of
workmanship and more than correspondent multiplication of expence.
Such are among the means by which a suit for
which, can the claimant, and if needful the defendant
allowed and obliged to make present their respective statements
in public to the ears of the Judge in the of
time a few hours or even minutes might have
is swollen into as many months or years: and is the a suit for which
in the article of time money expence in that same case
a few pounds or perhaps shillings would might have
sufficced the quantity of money expence has been swollen
from to hundreds of pounds or even thousands.
