Procedure CodeCh. Nullification
suffered to be snatched from him by anyone
who, to the desire, adds the physical faculty
of laying hands on it. Under this head, the following
are the topics which will fall to
be considered, and designated by so many sub-heads.
1. Acts on discourses to which this practice
has been applied.
2. Authorities, by which it has been applied.
3. Persons whose interest has been affected
by it.
Art. 3. First as to the acts or instruments
to which it has been applied. These are –
1. Conveyances immediate and eventual, by
which property is transferred, charged or discharged.
2. Contracts, by which one party is with his
own consent bound by law to render service
in some thereby designated shape. It may be
either simple or say unilateral or say reciprocal
or say plurilateral, of which the
most customary modification is bi-lateral.
3. Acts on Instruments of Procedure.
Art. 4. II. Authorities by which the practice
is carried on. These are – 1. The Legislative –
2. The Judicial. Highly important is this distinction –
Prodigious the difference between the
two cases indicated by it – important, as well
in respect of the lawfulness of it, as in respect
to the effects.
