of whatever is good in the law of property – the disappointment
preventive principle – is still more flagrant
and mischievous than in those two other
cases. On this part of the field of law, scarcely
anything has been established in the form of real
and Legislature made law. Exceptions excepted to
an amount scarce worth considering, whatever has
been done has been done by Judge made law
and that law a mere shadow – a fiction substituted
to the only really existing sort of law, not
having any existence, it never is known, nor is
capable of ever being so. Of this fiction, what is
the effect? Two wrongs – a private and a public wrong,
done by the same act. Private among the wrong done
to some individual; public wrong, an act of insubordination,
committed by disobedience to the declared
will of the Legislator – disobedience exemplified by
the frustration of one of it's enactments.
