Procedure CodeCh. Nullification
have been apprized of the existence of it: to
his being apprized of the existence of it, what is
necessary, is that at the time of his paying such
obedience, it should have existence: now this
is what in the case in question it never has.
For the case is that at the time of the individual
doing the act in question, the condition in
question has neither been made known to the
individual, nor so much as conceived in the
mind of the inventor of it: it is to this effect if
a person other than the individual in question
i.e. a professional lawyer, engaged by the individual
suitor to give him assistance on the occasion
in question, shall have drawn up a writing to
such or such an effect, or, what comes to the
same thing, abstained from drawing up a writing
to the effect in question. Now then what should
have been the cause of his doing so? What should
have been the inducement? What inducement
had the Judge in question or any other Judge
or any other person in authority, ever given him?
None whatever. Neither to the party, nor so much
as to the professional assistant had any intimation
been ever given, that of the lawyer's net doing
that which the suitor is thus dealth with
for not doing, or doing that which he is thus dealt
with for doing, such would be the effect.
