Ratiocinative
Art. 1. In prohibiting persons whose names
are not on the list of Professional Lawyers from acting a
gratuitous La professing to act as Gratuitous Assistants, and yet
receive, money or money's worth in return for such their
services, the purpose of the law is not to convert gratitude
into an offence, but to preserve persons in general from the
danger of employing comparatively unapt Law assistants by employing
persons in whose instance that security for appropriate aptitude
has no place, which it is the object of the law to provide
by means of the system of probationary instruction and probation which
it has provided.
Art. 2. Accordingly if in any other manner there be
the transference of money or money's worth it be the purpose of the client served
to testify gratitude confer, and of the law assistant to receive
a benefit, this comes not within the p inhibition meant to be
applied by the law: for from in any such indirect and casual way shape
no considerable and habitual stream, of can
be derived.
Enactive
Art. 3. So if on any occasion it be the desire
of the Professional Lawyer to render afford his assistance without
recompense in the shape of money or money's worth as above
there can be no objection to his so doing.
