Relation to the proposed Codes to those in France or English — including real Code
really existing and imaginary masses of law
In all Codes taken together Civil, Penal, and Procedure
Code. On topics that have presented themselves as never having
been touched I have set down in in the form of Enactment
or Instrument adding on occasion Exposition such
arrangements as the several cases appeared to require
On topics that were found to have been already landed
upon I have throughout given the enactments in my own
word. These amendments would thus it be to no small
extent different in substance from those at present in force
or regarded as being so.
But in respect of their form those arrangements
cases which I saw reason to appear not being in any instance
in my view of the matter so well adapted to what ought the purpose
of adequate expression as it appeared to me that they
might be rendered even in those cases the words are and
as well as in the other here beforementioned ones.
In the other parts of the field the exception being a part of that which
in the existing book is referred to the head of Evidence and a
part of that which is referred to the head of Equity and included
in the book or at any rate in one Book of Chancery
practice the matter of the adjective branch is kept pretty
well distant and separated from the matter of the substantive
branch: the wish is what the two heads if under or
respectively treated of being in several instances separate works.
