Art. 8. Subject matters
of Probation. Matter of
law and Matter of fact
Art. 8. Meantime to be effectual and adequate and the operation termed
probation must have had for its subject matter not only
the matter of fact by the existence of which adequate ground
is made constituted for the rendering of the judicial service in question
to wit by execution as above but also of the existence of a
portion of law by which on the individual occasion in question
permission has been given to the Judge in question, coupled with
obligation laid on him for the performance of that same service.
Probation as to the matter of fact law — probation as to the matter of fact
Matter of law and matter of fact these are both of them
on each occasion indispensable subject matter of probation — subject matter
without the probation of both which the Judge will not on any occasion
be warranted in the performance of any service in any
shape demanded at his hands: but at the same time only
that by the adequate probation of both he will find himself not
only warranted in rendering but lying under an obligation to render
that same service.

Art. 9. Moreover, to be effectual this viz to the
purpose of authorizing and obliging the Judge gaining authority and obligation to the Judge the continually and in case of need to render the judicial
service demanded at his hands, the proof exhibited must
remain adequate, after and notwithstanding whatsoever counterproof
may have been exhibited, free admission having been given to such counterproof
having at the same time been given: counterproof from the sources
the same as those from which the proof was exhibited, counterproof
from different sources, if any such have been made available had place
