Jud Procedure Code

Preface?

31
The demand with
grounds, few words necessary
for evidence, multitude
unlimited

The demand it will be seen may in every case
be expressed by a comparatively small quantity of words
the evidence, considering the multitude of the witnesses, to whose
testimony it happens in some cases to be delivered is capable
of being spun out to any length.

32
Hence for demand
and grounds, a proportionable
fee could
be exacted:
for evidence elicitation, not

The dem Being
in comparison this concise, the demand adequately or inadequately
expressed was in all cases wo where the Judge
had a Clerk or the plaintiff himself or an assistant practiced
in the art of writing capable of being consigned to writing.
Here then without entering before entering into any such
process as the elic that of elicitating eliciting the evidence here was
an operation for the performance of which the Judge was
in a condition enabled to exact a fee. Quoth the Judge to the plaintiff
I will hear when the time comes I will hear what
evidence you have to adduce in support of your demand:
but to make application of the evidence, and apply it to
use, I must first hear know and continue to know all along to
know what your demand is. Therefore, what you have to do
is, to express this demand in writing, yourself if you are
able; if not, some any person who will understand whom be understanding how, you
can engage to render you this service. This instrument of
demand when written, bring to me and I will take charge
of it: but in so doing, I must take upon me the corresponding trouble
and for taking the trouble, I like any other man must be
paid. You must pay me the price which in these all such cases
I have determined to require: this price is so much — say
3d and 4d: this I call my fee.

33
This done for
defence as well as
demand, hence here
we see Fees for Written pleadings

The language corresponding to the above, the Judge
holds to the Defendant and there we have written pleadings.
