3. Satisfactive
1.
For satisfaction, simple
restitution cannot
be adequate.
2.
To render it adequate
subsidiary compensation
is necessary on
the following accounts.
1. For loss of the use of
the thing during the time
it was withheld.
2. For natural deterioration.
3. For deterioration by use.
4. In many cases, ordinary
interest of value in
money not sufficient –
interest to be calculated
according to circumstances
of wrongee.
5. In every case, compensation
should suffice
to take from wrongdoer
the profit of his wrong.
6. Full compensation
often insufficient on
account of evil of 2d.
order.
3.
Responsibility of conformity
of decrees to
the ends of justice,
rests on the character
of the judge.
4.
He will therefore supply
the deficiency, when
either party fails to
bring to view the total
demand for satisfaction.
