§. Mental vexation simple
To the magnitude of the evil capable of being produced
and thence of the wrong capable of being afflicted
by these two sub species, there would be absolutely no limit
were it not for the above mentioned condition, namely,
that by the supposition, it must in the estimate
of the wrongee be less than the evil represented as being
impending. In the case of the other sub-species,
the limit is not so height of the evil in the scale
of evil is not so great as in the former case, but it
is still great enough to apply present an
imperative demand on the attention of the legislator,
and to require the giving the discretion of the judge
latitude sufficient to give admittance to a punishment
of very considerable severity. To

species of hoax: one may be styled the
terrifick of afflictive, the other the alluring and disappointment
producing hoax.
