Constitutional Penal CodeCh. IV. Offences title to property
Where a deed or evenascent ceremony
tendered equivalent to a deed, such for example
as the marriage ceremony is the subject matter
of the offence, the diversifications of which the
offence is susceptible, have above already been brought to view.
But in the same manner in which title to property
in any shape is capable of being in these several
ways affected, in the same manner are in the
same ways, and by offences of these same denominations,
is title to any other sort of valuable thing,
howsoever denominated, liable to be affected.
Take for example, power, exemption from obligation,
services of various sorts in miscellaneous shapes,
rank and condition in life, this list composed as it will
be found, in most, if not in all instances of a
combination of benefit with burthen. In all those
instances except the last, if the list of offences affecting
title will be found included, all of them, in the
foregoing list, all of them they being like all of them
like property benefits or evinces of benefit in
so many different shapes. But condition in life,
having its burdens, adhering in every instance
to its benefits, here then come in a class of offences,
corresponding indeed, with with – list corresponding indeed but forming at the same
time a perfect contrast with those to which it
stands exposed in the character of benefit.
