§. 2. Treason
Treason may be committed by the subject
of a foreign power, if resident within the division
of this state; for so long as he resides within the dominions
territory of this state, he enjoys the benefit of the protection
afforded by the authorities of this state, against
evil, by internal adversaries. And the part he
is taking against the power and peace of this state
may be still more noxious, than the species of hostility
exercised by a spy as such.
N.B. Treason may with propriety be
punished with more severity than rebellion,
for rebellion is but the continuation or commencement
of civil war, and in civil war – there is a double
reason why each party should treat the other
with less severity, than either would a foreign
enemy. If it be but the commencement on the
part of a few, the smaller the number the less the
mischief and the danger.
