Of Falshoods in general
the character in question was performed by the individual
person in question. For a fact It is not the person of the individual that is counterfeited by but his
act.
The distinction between Personation and Perjury - between Personation and Perjury
turns upon two points: 1. upon the nature of the fact averred
in the 1st instance: 2. the circumstance of solemnity upon the solemnity of the averment.
In Personation the fact in question is the particular sort of fact just
mentioned: in Perjury it may be any sort of fact whatever.
In Personation Perjury as has been before observed,
the averment is must have been accompanied by a particular solemnity.
The distinction between Forgery and Perjury
turns also upon two three points: 1. upon the nature of the signs employed in the averment 2. upon the nature of the fact
averred in the first instance: 3. upon the solemnity of
the averment. 1. In Forgery there fact in question must have
been signs of the permanent kind must havebeen employed:
In Perjury no such signs need have
been employed: on the contrary the signs employed are seldom
other than evanescent 2. In Forgery the fact averred
in the first instance must have been a fact of a particular
kind; viz: the fact that such and such signs of
the permanent kind have been made by such a person: in Perjury it
