Of Falshoods in general
of personal injury, for which on account of it's making
so little figure in the system it was seemed scarcely
worth while to find a new name. The particular
nature of it is very inexplicit and may be very
changeable. It imports not necessarily any thing more than may confine itself to a simple corporal
injury: but it may import besides a certain degree of confinement: or a
certain species of banishment. Moreover if an obligation
is imposed on any man person, it can hardly
be for at least it ought not to be, but for
the benefit of some other party: it is therefore a trust:
and as is the case in trust, the party for whose
benefit it is imposed may be an individual, a class a class
of individuals, or the public.+ + See Tit. Detriolation of Trust. If then the person on
whom the burthen of the trust is thus wrongfully imposed be less
fit for the trust than the person on whom it ought
by right to have lain, here then is an additional
mischief produced by the offence. If the burthen be
pecuniary, the offence is is of the nature of Destruction;
since it subjects the party injured to the
loss of so much of his property. In this case the
nature mischief of the offence may admit of some variation
according to the nature destination of the burthen: if
