Of Offences by Falshood
1 -justly thrown it would have fallen upon some
body else, the profit of the offence is to that somebody
else: if upon nobody the profit is to the person
by whom the money or money's worth is to be received. To p. 43. at top

title of honour comes under the nature may be consider'd as a species of Defraudment,
in as much as a title of honour may be
consider'd as an incorporeal article of property. The
case is little different where the purpose of the falshood
is not to obtain not the legal possession
of the dignity, but only that sort of reputation which
results to a man from being looked upon as the right to possessing it.
The parties prejudiced here are 1. the persons at large
at whose expence the honour is created in virtue
of the tribute of respect and obsequiousness which
it disposes them to pay: 2. persons lawfully invested
with the same honour: the value of which is of course diminished
in proportion to the number of those with whom it
is shared. In the 1st of these cases, degradation will
be necessary in order to deprive the offender of the profit
of the offence: in the 2d the ceremonies of degradation
may be of use in adding to the characteristicalness
