Of Falshoods in general.
Artifice of Legislators &c with the same severity, the punishment might have
appeared so great and so disproportionate to the offence
as to have given umbrage: whereas upon exacting
the declaration, if the declaration prove false or counterfeit,
and the offender be punished as for the
falsity, with the self-same punishment the severity of the legislator passes unheeded,
or the sentiments of the people bear him out in it.
All this while the real hardship upon the subject is rather
increased than lessened by the contrivances. The obligation
of making or procuring the declaration in question is
but an additional burthen: it adds to the is attended
with necessarily with trouble, commonly with expence,
and contributes moreover to add strength to the sentiment
of co-ercion, a sentiment which though so often necessary
is never pleasing.
Besides quieting opposition, the legislator by their
contrivance gains the people over to his side. arming himself
with the force of the moral sanction, in aid conjunction
with his own. Offences of the nature The offences in question
are of the member of those which how well
soever they may merit it, are seldom regarded by
the people in any ignominious light. But Forgery
