mischief of the offence, it may not be easy to find
an answer. The truth is that if the extra punishments
here proposed are to be justified as it should
seem they might be when standing in the character of extra-
punishments it can only be by on one or other of two
grounds. 1. the indication which this
extra circumstance in question affords of an evil extra-ordinary
depravity of disposition: 2. the use which such punishments may
be of against offences of a congenial nature in the
character of a moral lesson.
1. the depravity of disposition indicated by the offence
The depravity of the disposition is evidenced by
by two considerations. 1. the reflection which the
nature of the case shows must have been bestowed upon the
offence. This shows serves to show that it is not the offence result of a sudden
impulse but of a deep-rooted propensity; and that since
it is not in the power even of reflection to give to the social
affections the ascendency over those selfish or disproval motives principles
which operate upon this occasion in the character of impelling motives.
2. the slight ness of the influence which it shows the moral sanction
in particular to possess: since it proves insufficient to deter
the offender from employing such effecting his design by means which it is in use reprobate
in their non account were without regard to independently on the
particular purpose to which they are applied.
