phrase is fucum facire to put a false
gloss or varnish upon the appearances of
things.
Fucation is institutive creative or obliterative. Now facts, it is to be observed, are either
negative or positive: and to this distinction will
correspond another distinction between two species
of fucation. When the object portion design is to cause it
to be believed that a fact has happened which in truth
has not happened. the effect of the fucation must
be to put superinduce thing the facts objects which are to be
made to serve as evidences of it the fact that in question some new
appearances which they exhibited not of themselves:
in this case the fucation may be stiled positive
or creative. When the design is to cause it to be
believed that a fact has not happen'd which
in truth has happen'd the effect of the fucation
must be to obliterate as it were so to deal with so to deal with
the objects which at present of themselves served as
evidences of it's having happen'd as to obliterate
those appearances in virtue of which they served
to inculcate that belief: in this case the fucation
may be stiled obliterative. For on this occasion
it is common enough to say that the appearances which
served as traces of the fact are obliterated.
