Genuine Instrument,

2. For an instrument to be genuine, it must have been executed,
(AA) 1. (If the person be material) by the person by whom it purports
to have been made. 2. (If the time be material) at the
time at which it purports to have been made: 3. (If the place
be material) at the place at which it purports to be have been made.
Ways in which an
instrument may be
executed. [(AA) Executed] 1st An instrument purporting to contain the declaration
of any party may be authenticated by him by any mark made
in the intent of expressing his concurrence with the contents; as
by signing his name, or, if he cannot write, making any other
kind of mark; or by affixing a seal, a stamp, or any other such
implement contrived for making an impression.
