Offences against Condition - Adultery
It will be proper on this occasion to state what
the mischief of Adultery is; and why it is requisite
to punish the woman more than the man.
Adultery is a breach of that contract whereby
a man and a woman engage to live together
for the sake of reaping in [deriving from] each other two
company and from that alone the pleasures of love or the pleasure
of having children, or both.
The mischiefs of adultery will depend upon
the clear amount of the advantages benefits which are
procured by result from the establishing ment and enforcing it. What are those advantages? and in what respect how
& how far do they overbalance the disadvantages inconveniences?
The inconveniences resulting from the observance
of such a contract on the man's side are palpable
After enjoying the pleasures in question with one
woman for a certain time it will almost
happen that he might enjoy reap the same pleasure
in a greater degree from the company of some another. It is the same with regard to the woman.
With regard to the pleasures of love, what
ought to be the object of the Legislator? clearly
the same as with regard to all other pleasures:
viz: that as many persons possible may enjoy
as much of this sort of pleasure as possible, so
as not to buy any part of it at the expence
of a greater quantity of pleasure derivable from
any other source, or not at the expence of suffering
a more than equivalent quantity of pain.
