Offences against Condition — Adultery. Reasons

2. A man's money is as much a bait to one
pickpocket as to another: and making an allowance for different degrees of dexterity it is as much in danger
from one pickpocket as another. He has
therefore as much to fear from one pickpocket as
from another: and so that every man has to fear from every
pickpocket: This is not the case with ev accordingly if you hear that such a man
has had his pocket picked in such a street neighbourhood,
you can not but think yourself in as much
danger liable to have your pocket picked by the
same pick-pocket as he was. This is not the case
with adultery. A man's wife is not as much a
bait to one adulterer as to another: nor is he
as much in danger from one adulterer as from
another. It is not from every adulterer that any man has
to fear. Such a man you hear has had his wife
seduced by such another. But what is that to you?
the your wife knows nothing of that adulterer: the adulterer
knows nothing of your wife. Have you any apprehensions
of his making an acquaintance with
her? it will be strange indeed if you have it not
in your power to prevent it.

We may now see one reason why the punishment for
adultery ought not to be any more than what
in almost all established systems of Jurisprudence it actually
is, not so great as that of Rape. Some writers
however have sometimes been apt to wish that
it were greater. Would it not be worse to you, say
they, to lose have your the person of your wife defiled
and lose her affections too, than to have her person only defiled,
