C Of Family Imposture. Extenuations Excuses are

Purpose temporary. 1. Where the Offender meant to continue the imposition no longer
than for a limited time for the sake of a particular purpose.
In such case, if it be for the sake of fraudulently obtaining
a Sum of money or any article of property the value of which
extends not beyond a certain sum of Money, the Offender in lieu
of other punishment may be punished as for sharping to that
amount.

Observations.

There are some cases of Family Imposture which are
possible, but which seem scarce worth making a separate provission
for. Such is the case of a man's personating the husband of a
woman for instance in the Masquerade, or in the dark, or if she
be blind, at any time, for the purpose of debauching her.
Such an attempt were it to miscarry would do no harm,
and if it succeeds it is punishable on the part of the impostor
as adultery, though on the part of the woman it would be innocent.
Such a case comes manifestly under the above Extenuation Excuse.
It may be punished as Adultery; but it is hardly so injurious
as
