C Of Injuries to the liberty of Loco-motion Of Unlawful Confinement.

Measures of the Evils or Hardships produced by the confinement. The measure of these hardships will be determined
by four circumstances: viz, 1. The closeness of the confinement:
2. The severity of it. 3. The continuance of it. 4.
The prejudicial consequences attending it.

Closseness of it, what — The confinement may be said to be closer according
as the space a man is confined in is the smaller.

—Severity Confinement may be said to be the more severe according
as the hardships which he may have been made
to suffer during the confinement over and above those
which have resulted necessarily from the closeness of it
are greater and more numerous.

Instructions to the Judge.

Evils or hardships apt to result from the closseness of it. The hardships which are apt to result
merely from the closeness of a man's confinement seem
principally to be as follows.

1. Privation of the Liberty - of beholding and unlimited variety
of rural objects and other objects that afford amusement
to the Eye and Imagination.
