Observations.
Concerning the Justifications admitted in this case with regard to
the offence of Kidnapping Unlawful Confinement: particularly
when aggravated by the 1st ground of aggravation; viz.
strangeness of the place.
1. Consent With regard to the first article in the general catalogue of The first Justifications, to wit, Consent, this stands excluded is precluded by the
Definition of the offence.
2. Medical practice With regard to the The second, third, and fourth, viz. Medical practice,
Precaution against Calamity — Defence. Precaution against calamity and Defence, can scarcely even the case must be
an extraordinary one to admitt of them. It certainly however
is not impossible they should take place. take place in point of fact. With regard to the two first all of them, cases
